What Is a Cannabis-Based Prescription?

A cannabis-based prescription — more formally known as a prescription for a Cannabis-Based Product for Medicinal Use (CBPM) — is a legal prescription issued by a GMC-registered specialist doctor for a cannabis-derived pharmaceutical product. It is a legal document, issued by a qualified clinician, for a regulated medicine. It is not a grey-area document. It is not a loophole. It is a legitimate medical prescription governed by the Misuse of Drugs Regulations 2001 as amended in November 2018, the Medicines Act 1968 and the MHRA's guidance on unlicensed medicines.

Cannabis-based prescriptions in the UK are almost exclusively issued by private medical cannabis clinics — specialist practices that employ or engage GMC-registered consultants to assess patient eligibility and issue prescriptions where clinically appropriate. The NHS issues cannabis-based prescriptions in extremely limited circumstances — primarily for three specific licensed products — and the vast majority of UK patients access their treatment through private clinics.

As of 2026, between 80,000 and 100,000 UK patients hold a current cannabis-based prescription. An estimated 1.4 million more people are still accessing cannabis illegally to manage the same health conditions. Source: LBC November 2025; UKMC Group industry estimates 2026.

How Medical Cannabis Clinics Issue Cannabis-Based Prescriptions

A cannabis-based prescription follows a structured clinical pathway. Understanding this pathway is important for any patient navigating the UK medical cannabis system for the first time.

01

Eligibility Assessment

Most licensed UK medical cannabis clinics offer a free online eligibility check. The patient provides information about their condition, their medical history and the conventional treatments they have already tried. The clinic uses this to make an initial assessment of whether a specialist consultation is likely to be productive. The eligibility check is not a diagnosis and does not commit the patient to anything.

02

Specialist Consultation

If the eligibility check is positive, the patient books a video consultation with a GMC-registered specialist doctor — typically a consultant in pain medicine, psychiatry, neurology or another relevant specialism. The consultation reviews the patient's full medical history, assesses the clinical case for a cannabis-based prescription and determines whether the benefits are likely to outweigh the risks for that specific patient.

03

Prescription Issued

If the specialist determines that the patient qualifies — having tried at least two conventional treatments without sufficient benefit — a prescription is issued. For most products, a second specialist review is conducted before the prescription is finalised. The prescription is a legal medical document naming the patient, the prescribing doctor, the product, the dose and the administration method.

04

Pharmacy Dispensing

The prescription is sent to a licensed UK pharmacy — most clinics use a specific partner pharmacy — which dispenses the medication and arranges discreet home delivery. Most prescriptions arrive within three to five working days. Medication is dispensed in original, labelled pharmacy packaging with full dispensing information.

05

Ongoing Review

Most UK medical cannabis clinics operate a follow-up consultation model — reviewing the prescription every three months, adjusting dosage or product as needed and monitoring patient response. Repeat prescriptions are processed between appointments with continued home delivery.

Your Rights as a UK Cannabis-Based Prescription Holder

Holding a valid UK cannabis-based prescription confers specific legal rights and protections that every patient should understand.

LEGAL FRAMEWORK

Right to Possess Your Prescribed Medication

A valid cannabis-based prescription gives you the legal right to possess the cannabis-based medicinal product named on that prescription. Cannabis remains a Class B controlled substance under the Misuse of Drugs Act 1971, but the rescheduling in 2018 means that possession of a prescribed CBPM by the named patient is lawful. Keep your prescription documentation — your prescription letter or pharmacy delivery note — accessible when carrying your medication.

JANUARY 2026 GUIDANCE

Patients First, Suspects Second

New UK police guidance issued in January 2026 instructs officers to treat medical cannabis patients as "patients first, suspects second." Officers are instructed to verify a prescription before taking any enforcement action. Carrying your prescription documentation is strongly recommended. Having a prescription provides a legal defence in the event of any police interaction regarding your medication. Source: MCPH 2026; PatientsCann 2026. EMPLOYMENT CONSIDERATIONS

Your Prescription and Your Employer

Cannabis-based prescriptions are legal medical prescriptions. You are not obligated to disclose your prescription to your employer unless your role involves safety-critical activities where impairment is a risk — such as operating heavy machinery or driving as part of your employment. PatientsCann provides template letters for discussing medical cannabis with employers. This is general information only — seek independent employment law advice for specific situations.
